Home Schooling Laws in California
State law requires all children between the ages of 6 and 18 to be enrolled in a public school, unless they are attending a "full-time, private day school" or being instructed by a private tutor who holds a valid California teaching certificate. (California Education Code §48222)
This allows California homeschooling parents four options:
- Establish a home-based private school – This requires filing a “Private School Affidavit” or PSA, formerly known as R-4. This option is for the family who wants to “go it on their own.” This establishes your child's exemption from compulsory public school.
New Earth Cyber School can support you in this process with suggested curriculum, teaching time, tutoring time, resources and academic plans.
- Enroll in a Private School that offers independent study - This option allows for flexibility in curriculum choice and learning style. Support is given by the school staff and groups activities and resources are available.
New Earth Cyber School is already established as a Private School Satellite Program and can also provide alternative and joint support to this option - we can explore the possibilities together.
- Enroll in a Public School or Charter School that offers an Independent Study Program or ISP. This option is paid for by state funds, curriculum is required to be state approved, and families and students are required to maintain supervision by a credentialed teacher.
Often a child needs extra support beyond the minimal teacher time this option provides. New Earth Cyber School can offer additional teacher time at an affordable rate utilizing a credentialed teacher with special education expertise.
- Utilize a Credentialed Teacher/Tutor - A parent with a current California teacher's credential may teach his/her child under the private tutorial exemption. The parent can use this option only for the grades their credential covers. Parents may also hire a credentialed tutor for their child. No notification is required, but tutors are required to teach for a minimum of three hours each day, 175 days per school year, Monday through Friday, between the hours of 8:00 am and 4:00 pm. These minimums do not apply to private schools.
